Two people were ejected and two more were pinned inside their vehicle after an accident on River Road (Route 112) in Buxton early Saturday morning. According to Buxton Police Chief Michael Grovo, around 6:32 a.m. police were notified that a Chevrolet Malibu traveling south on River Road went off the road and struck a tree around Back Nippen Road. After the two people pinned inside the vehicle were extricated, they were taken by Life Flight helicopter to Maine Medical Center. The other two injured people were also transported by ambulance to Maine Medical Center. The accident is under investigation by Buxton police and Maine State Police, but Grovo said at this time it appears speed and alcohol are factors in the accident. River Road was closed from 6:30 a.m. to 10 a.m.

WELLS, Maine  — Police say a man, 46, holding a yard sale died in a multi-car accident in Wells on Saturday.  Wells Police say a man, 72, was driving down North Berwick Road (Route 9) around 8:45 AM Saturday.  Police say he noticed a yard sale and pulled a U-turn to go back to it. While his truck was across the road, another truck hauling a 30-foot camper trailer struck that man’s vehicle.  The trailer jack-knifed and smashed into a yard sale. The trailer hit and pinned the man holding the yard sale and his mother-in-law, 67.  She was trapped under a small stairway in the trailer and survived.  She was taken to a hospital with non life-threatening injuries. Her son-in-law, the man holding the yard sale, was also taken to the hospital where he was pronounced dead.

The man driving the pick-up truck was hospitalized with a broken neck and other broken bones.  He is expected to survive. The people in the truck hauling the trailer – two adults and two children – suffered only minor injuries and were not taken to the hospital.

Police had Rt. 9 closed down for 6 hours.  State Police helped in the reconstruction.  Wells police are waiting for a full report to decide whether any charges will be filed. The stretch of Route 9 where the accident happened is a 50 mile an hour zone.  Police do not think alcohol or excessive speed were factors in the crash.

Preserving Civil Justice

Wednesday, May 19th, 2010

As governor of the American Association for Justice, I see a steady stream of challenges and criticisms aimed at lawyers and civil justice. It is important to remember how the civil justice system serves the disenfranchised.  The contingent fee system is at the core of that system. It allows those who otherwise could not afford an attorney to stand up for them and their rights to retain the very best lawyers to represent them.   The case cited here ( ContingencyFee 4th Abrams case 5 10 ) out of the United States 4th Circuit Court of Appeals, restates and reinforces the indispensible role of the contingent fee relationship in preserving access to justice for all Americans, not just the wealthy and powerful.

Contact Experienced Personal Injury Attorney: Pittsfield Woman Injured in Crash

TROY, Maine — A Pittsfield woman was flown to Eastern Maine Medical Center in Bangor Tuesday night after her vehicle went off Route 9, flipped three times and pinned her underneath. The woman, 21, is still being evaluated but was expected to be listed in fair condition by the end of the night, said Trooper Jon Russell of Maine State Police Troop D. “Driver distraction seems to be the major factor,” he said. “It’s just not known right now exactly what the distraction was.” Russell said that he had just left the hospital, where he was unable to speak to her but learned that she did not appear to have suffered internal injuries. Another motorist, a woman, was traveling in the opposite direction at 6:30 p.m. and witnessed the crash, Russell said.

The Pittsfield woman was alone in a 2000 Dodge Caravan when she ran off the road, struck an embankment and started to flip. She was ejected and was “100 percent pinned” underneath, suffering a dislocated hip and some burns on her right leg, according to the trooper. “The burns were received as she was pinned under the vehicle from the engine heat,” Russell said. The witness shut off the Caravan and called 911, he said. “Alcohol was not involved and speed doesn’t seem to be a factor,” Russell said. The woman apparently was not wearing her seat belt at the time of the accident. Unity Rescue, the Troy Fire Department and the Waldo County Sheriff’s Office also went to the accident scene, which was cleared at 8:50 p.m., Russell said.

Although this was a single car accident, recovery for the injured victim may be possible.  The product liability team at Berman & Simmons has successfully recovered against major auto manufacturers in one-car accidents where a defective or dangerous condition of the car caused or contributed to the accident.  In this case, there may be a question of medical advice or malpractice if the accident was caused by a treatable medical condition or reaction to a prescription medication.  For more information, contact Berman & Simmons at 1-800-244-3576 or read more on our website on our car accident practice page.

BELFAST, Maine — Three Belfast Area High School students were injured and taken to the hospital Friday night after their car struck a tree. The crash occurred at around 8:15 p.m. on Back Searsport Road when the 2002 Daewoo in which the three male students were riding left the road for unknown reasons and hit the tree, Sgt. Walter Corey with the Belfast Police Department said Saturday. The names of the three victims were not released because they are all under age 18. Corey said a 16-year-old and one 17-year-old passenger were taken by LifeFlight helicopter to Eastern Maine Medical Center in Bangor for treatment, while a third 17-year-old was taken to Waldo County General Hospital. He was later transferred to EMMC. The 16-year-old suffered severe injuries and was possibly going to be flown to Boston for treatment, Corey said.

Corey said it was still unclear on Saturday what caused the crash but added that alcohol did not appear to be a factor. A Maine State Police accident reconstruction team was brought in to assist with the investigation. No other information was available Sunday

Although this was a single car accident, recovery for the injured victims may be possible.  The product liability team at Berman & Simmons has successfully recovered against major auto manufacturers in one-car accidents where a defective or dangerous condition of the car caused or contributed to the accident.  Recovery for the passengers may also be possible through the driver’s liability insurance policy, particularly if the driver was speeding or otherwise negligent, or the passenger’s own underinsured or uninsured motorist policy.   For more information, contact Berman & Simmons at 1-800-244-3576 or read more on our website on our car accident practice page.
