$8.9 Million Verdict For Woman Whose Newborn Suffered Severe Brain Damage

Portland, Cumberland County, Maine. Due to defendant’s negligence, plaintiffs’ daughter was born with cerebral palsy and brain damage. After a prolonged labor, plaintiff requested to have a C-section but her doctor urged her to “stay the course” toward a vaginal delivery. Several hours later baby experienced a decelerated fetal heart rate and mother screamed in pain. Subsequently a c-section was performed but by then infant had suffered a severe birth injury. The jury awarded a total verdict of $8.9 Million, including $7,485,000 awarded to the baby and $1,500,000 to the baby’s mother for her own emotional distress.
